Coti claims it is running on a proprietary consensus algorithm and Charles proclaimed he would not work with patented systems.
Is there any reason why Coti is exempted?

Did he actually say that he will not work with patented systems? I think it was more along the lines of he’s not interested in patented systems… Cardano is not about excluding everything that is not open source. Ideascale is not open source, and is a temporary partner being used until voltare era comes into effect.
