ECC Statement

On the Constitutional Committee Operating Below Minimum Threshold and Voting Participation for GA75 & GA76


Community members,

On 26 November 2025, the Cardano Atlantic Council (CAC) — one of the members of the Constitutional Committee (CC) — formally retired.

Under the Cardano Constitution and CIP-1694, the CC is required to maintain a number of members not lower than the on-chain parameter committeeMinSize.
The current value of committeeMinSize is 7.

Following the retirement of CAC, the Constitutional Committee now has 6 non-expired members, which is below the minimum requirement of 7. This means the CC no longer satisfies the validity conditions necessary to perform constitutional oversight and ratification duties.

ECC Position Based on the Cardano Constitution & CIP-1694

The Cardano Constitution and CIP-1694 specify that when the number of CC members falls below committeeMinSize, the CC is no longer valid for performing oversight or ratification functions.

Proceeding with votes while the CC is below the minimum threshold may result in outcomes that cannot be constitutionally ratified, raising concerns about validity and post-vote execution.

Therefore, the ECC will temporarily refrain from participating in on-chain voting for:

(1) 2 Governance Actions submitted after 26 November 2025

(2) And all Governance Actions submitted after 26 November 2025 and before the CC Update Action is approved on-chain.

Conditions for ECC to Resume On-Chain Voting

The ECC will resume evaluation and on-chain voting only after both of the following conditions are met:

1. The Constitutional Committee membership is restored to at least the required committeeMinSize (i.e., 7 members).

2. A CC Update Action is approved on-chain, formally re-establishing a valid Constitutional Committee.

Once these conditions are satisfied, the ECC will:

  • Reevaluate GA75 and GA76 based on merit and constitutional alignment,

  • And review any other Governance Actions submitted during the interim period.

Guidance for Proposers

The ECC encourages proposers to consider the operational state of the Constitutional Committee when submitting Governance Actions.

Submitting proposals during periods when the CC does not meet committeeMinSize may:

  • Delay evaluation,

  • Prevent constitutional ratification,

  • And extend the overall implementation timeline of the proposal.

The ECC remains available to provide clarification regarding the constitutional framework or any details in this statement.
